2. Eligibility
You must be at least 18 years old and competent to contract under Indian law to use our services. If you order on behalf of a business, you confirm that you are authorised to bind that business to these terms.
3. Our services
We provide web design services, such as the design of business websites, landing pages, online stores and the redesign of existing websites, as described in the quote we agree with you.
- Web hosting and domain names are not part of a design project unless the quote says so. We do not register domain names.
- Hosting is available separately through our sister brand Kippo Cloud and is governed by the Kippo Cloud terms of service.
4. Using this website
You agree to give us accurate information when you contact us or place an order, and not to misuse this website, for example by attempting to gain unauthorised access, disrupt it, or copy its content for commercial use without our permission.
5. Quotes and scope of work
- Before a project starts, we give you a quote describing the work, the price and the expected timeline. A project begins once you accept the quote and pay any advance it requires.
- The quote, together with these terms, is the agreement for that project.
- Work that is not described in the quote, including extra pages, new features or changes requested after the project starts, is outside the scope and will be quoted and charged separately.
- We may decline any project at our discretion.
6. Payment and taxes
- Prices are in Indian Rupees (INR) unless the quote says otherwise.
- Goods and Services Tax (GST) and any other applicable taxes will be charged in addition to the quoted price where applicable, and shown on your invoice. Business customers may provide a valid GSTIN to receive a GST invoice.
- Payments are due as set out in the quote, for example as an advance and one or more milestone payments.
- If a payment is overdue, we may pause work until it is received. The website, design files and login details are handed over only after the project has been paid for in full.
- Third-party costs such as domain names, hosting, paid themes, plugins, fonts, stock images and payment gateway fees are not included unless the quote says so.
- Payments are processed by third-party payment gateways. We do not store your full card or bank details.
7. Your responsibilities
- You will provide the content, images, logins and feedback we need to do the work, in good time. Delays on your side will move the timeline.
- You confirm that you own, or have permission to use, all text, images, logos and other material you give us, and that our use of it for your project will not infringe anyone's rights.
- You are responsible for the accuracy and legality of the content published on your website.
8. Timelines
Timelines in a quote are estimates. We work to meet them, but they are not guaranteed and depend on timely content, feedback and payments from you.
9. Revisions and approval
Each project includes the revisions stated in the quote. Further revisions are charged separately. Your project is treated as accepted when you approve it or when the website goes live, whichever happens first. Please report any defects in the agreed work promptly so we can fix them.
10. Ownership of the work
- Once you have paid for the project in full, you own the final design and the content created specifically for your website.
- We keep ownership of our pre-existing tools, templates and know-how, and of design concepts you did not choose, and give you a licence to use any of our tools and templates that form part of your website.
- Third-party material used in your website, such as fonts, stock images, themes, plugins and open-source software, remains under its own licence.
- We may show the finished work in our portfolio unless you ask us in writing not to.
11. Support after launch
After your website goes live, we provide support and maintenance only as stated in the quote or in a separate maintenance agreement. We are not responsible for problems caused by changes made by you or a third party, or by updates to third-party software.
12. Hosting and third-party services
If your website is hosted with Kippo Cloud, the Kippo Cloud terms apply to the hosting. If it is hosted with another provider, or relies on third-party services such as payment gateways, email or domain registrars, we are not responsible for the availability or conduct of those services.
13. Acceptable use
We will not design websites for:
- content or activity that is unlawful under Indian law, including anything prohibited under the Information Technology Act, 2000 and the rules made under it;
- malware, phishing pages or other harmful code;
- content that infringes copyright, trademarks or other intellectual property rights;
- content that is obscene, defamatory, or promotes violence or hatred.
If we find that a project falls within this section, we may stop work immediately without a refund.
14. Cancellation
You may cancel a project at any time by writing to us. Payments already made are not refundable. See our Refund policy.
15. Disclaimer of warranties
Our services are provided "as is" and "as available". To the extent permitted by law, we make no warranties that a website we design will achieve particular results, such as search rankings, traffic or sales, or that it will be error-free or uninterrupted.
16. Limitation of liability
To the extent permitted by law, we are not liable for any indirect, incidental, special or consequential losses, including loss of data, revenue, profits or business. Our total liability for any claim relating to our services is limited to the amount you paid us for the affected project. Nothing in these terms limits any liability that cannot be limited under Indian law.
17. Indemnity
You agree to indemnify and hold us harmless from any claims, losses or costs arising from your breach of these terms or applicable law, or from the content and material you provide for your project.
18. Privacy
We handle your personal data as described in our Privacy policy.
19. Force majeure
We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, network or power failures, cyber attacks, government action or other force majeure events.
20. Changes to these terms
We may update these terms from time to time. We will post the updated version on this page with a new "last updated" date. Continuing to use our services after changes take effect means you accept them. A project already in progress stays under the terms that applied when its quote was accepted.
21. Governing law and disputes
These terms are governed by the laws of India. You agree to first contact us to try to resolve any dispute informally. Subject to that, the courts at Ashoknagar, Madhya Pradesh shall have exclusive jurisdiction. This does not affect any rights you have as a consumer under the Consumer Protection Act, 2019.
22. Complaints
If you have a complaint, please email us at … or raise a ticket in the client area. We will acknowledge your complaint within 48 hours and aim to resolve it within one month of receipt.
